Important Changes to DPVAT Insurance: Everything You Need to Know about the New Rules in 2024-2025


The proposal to create the SPVAT includes an increase in safety resources and medical assistance for the population.


The DPVAT Insurance (Seguro de Danos Pessoais Causados por Veículos Automotores de Via Terrestre) is an essential guarantee for victims of traffic accidents in Brazil. Established in 1974, it offers compensation regardless of fault, with the aim of protecting drivers, passengers and pedestrians involved in accidents.


In 2023, an important change was enacted by law 14.544/23, designating Caixa Econômica Federal (CEF) to manage the resources of the DPVAT Fund. This meant that CEF began to manage compensation claims and make payments to victims of traffic accidents.


However, since 2021, the collection of DPVAT has been suspended, according to CNSP resolution 399/20. Even so, CEF took over management and compensation in 2023, guaranteeing protection for victims.


However, the payment of indemnities by CEF was suspended in November 2023, due to the exhaustion of available resources.


Recently, the Chamber of Deputies approved the basic text of PLP 233/23, proposing the creation of the Insurance for the Protection of Victims of Traffic Accidents (SPVAT), replacing DPVAT. This proposal brings several significant changes:


  1. End of DPVAT and creation of SPVAT: DPVAT, in force since 1974, will be abolished and replaced by SPVAT, possibly in 2025, with a focus on compensating victims and rehabilitation.

  2. Increased possibilities for reimbursement of medical expenses: SPVAT will expand coverage, including reimbursement of medical, funeral and professional rehabilitation expenses.

  3. Payment of compensation: Payments will begin after the implementation of the mutual fund, covering accidents from January 2024 and those occurring between November and December 2023.

  4. Transfer of funds collected: A portion of the funds collected will be passed on to municipalities and states with public transportation services.

  5. Penalties for non-payment of the premium: Non-payment will subject owners to fines, constituting a serious offense.


Although these changes represent progress, there are still outstanding points, such as the value of the basic tariff and the date on which the SPVAT comes into effect, to be defined by the CNSP and regulated by the Ministry of Economy.


The approval of PLP 233/23 marks an important step towards building a fairer and more efficient protection system. The expectation is for a system that contributes to reducing accidents and guarantees adequate support for victims.
